James Wyse

Mr. Wyse counsels clients on real estate, contract and estate planning matters, and is a recognized expert in the field of conservation and land preservation law. His counseling includes advisory work for families interested in planning for the long-term preservation of family landholdings, tax planning, and representation of nonprofit organizations in a wide range of areas, including structuring and financing of land acquisitions and review of operating practices and policies. He is counsel to New Jersey Conservation Foundation and the New Jersey Election Law Enforcement Commission. In addition to his real estate and estate planning practice, he has appeared in federal and state appellate courts on issues ranging from Freshwater Wetlands regulation to state political campaign financing and disclosure requirements.

Mr. Wyse has authored articles in various publications concerning conservation easement law, and regularly lectures on topics relating to conservation transactions, tax aspects of qualified charitable contributions, and lobbying rules. He is a contributor to the Model Conservation Easement, a publication of the Land Trust Alliance and The Trust for Public Land, and recently served as editor of the new revision of its Conservation Easement Handbook. Prior to joining Herold Law, P.A., Mr. Wyse practiced law with a Morristown firm, where he represented the Morristown and Morris Township Library in its successful defense of a highly publicized case of alleged violation of First and Fourteenth Amendment rights.
